Ulta3 Golden Hour, Golden Moments Competition - Terms & Conditions

Ulta3/The Heat Group Pty Ltd, ABN 58 092 941 430, 11 Dalmore Drive, Scoresby, Victoria, 3179 ( Promoter) is responsible for conducting the Ulta3 Golden Hour, Golden Moments Competition (Competition). By participating in this Competition you are deemed to have accepted these terms and conditions and all other information and instructions provided prior to entering the Competition. Any entry not complying with these terms and conditions will be deemed invalid.

The Promoter will respond to queries, manage the entry and judging processes and award the Competition prize.

  1. Instructions on how to enter this Competition form part of the conditions of entry. By participating, entrants agree to be bound by these conditions.

  2. Entry is only open to residents of Australia who are aged 18 and over. The directors, management and employees of the Promoter or its agencies and companies associated with this Competition are not eligible to enter.

  3. The Promoter is responsible for determining whether a person is an eligible entrant in its absolute discretion.

  4. Entry to the Competition commences from Monday 13th September, 2021 and closes at midnight AEDST on 1st November, 2021 (the Promotional Period).

    How To Enter
  5. To enter the Competition and be eligible to win the prize each entrant must do all the following:

    a. Follow ulta3 brand Instagram account: @ulta3
    b. Use a Golden Hour product from the promotion
    c. Post an original selfie photo (photo of one’s self) to their public Instagram account
    d. Must tag @ulta3
    e. Must use hashtags: #ulta3queens #goldenhour

  6. By submitting an entry, entrants warrant to the Promoter that: a. Their entry complies with the Submission Criteria b. They own all the rights to the entry; and c. Their photo/video has not been used in other social media advertisements

  7. Entrants warrant and agree that their entry is original and does not infringe the intellectual property rights of any third party. Further, entrants agree that ownership of any intellectual property rights, including moral rights, in their entry and any material created pursuant to their entry, are assigned to the Promoter without the payment of any further fee or compensation.

  8. Entrants acknowledge that the Promoter may use their entry, during the Promotional Period and afterwards, in any manner the Promoter sees fit including to encourage others to enter the Competition on Facebook, Instagram and/or TikTok.

  9. Entrants acknowledge that any use of their entry by the Promoter during the Promotional Period does not constitute endorsement of their entry or guarantee that their entry will be shortlisted or will win a prize.

  10. Entrants agree that they are fully responsible for the photos and/or videos they submit. The Promoter shall not be liable in any way for such entry, to the full extent permitted by law. The Promoter may remove any entry, material, photo and/or video from its social media pages without notice for any reason whatsoever.

  11. Without limiting any other terms and conditions contained herein, entrants agree to indemnify and hold the Promoter, its affiliates and sub-licensees, harmless from any and all claims, damages, expenses, costs (including reasonable legal fees) and liabilities (including settlements), brought or asserted by any person or third party against the Promoter, its affiliates or sub- licensees, due to, arising out of or in connection with the Competition, the prize, photos/videos submitted by an entrant or the Promoter’s use thereof, or an entrant’s conduct in connection with this Competition.

  12. The promoter reserves the right to verify the validity of entries and to disqualify any entrant whom the promoter believes either has tampered with the entry process, or has submitted an entry otherwise than in accordance with these conditions of entry.

    Submission Criteria:
  13. Entries made to the Competition (“Submissions”) must:

    a. Be original and not infringe the intellectual property rights of any third party.
    b. Have been taken/created within the Promotional Period.
    c. Not contain material that is, or that is deemed by the Promoter to be:

    i. unlawful or fraudulent;
    ii. in breach of any intellectual property, privacy, publicity or other rights;
    iii. offensive, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, indecent, profane, abusive, harassing or threatening;
    iv. objectionable with respect to race, religion, origin or gender;
    v. otherwise unsuitable for publication or display in Australia in any media.

    d. Not contain any copyrighted works except those owned by the entrant and which the entrant has the right to use and assign ownership in to the Promoter (including copyrighted video, music, artwork or text) such that any copyright or other intellectual property rights in the entry may be assigned to the Promoter in accordance with the terms and conditions.
    e. Not contain any viruses or cause injury or harm to any person or animal;
    f. Comply with:

    i. All relevant laws and regulations (including those relating to copyright, advertising, defamation, privacy, publicity, computer use and the access or use of others’ computer or communication systems);
    ii. the Australian Association of National Advertisers Code of Ethics, Australian Association of National Advertisers Food & Beverages: Advertising & Marketing Communications Code and any other relevant Australian Association of National Advertiser Codes (available at

    Without limiting any other terms herein and to the extent permitted by law, Entrants agree to indemnify the Promoter for any breach of the above terms.

    Promotional Period Judging 
  14. All valid entries received during the Promotional Period will be reviewed by a panel of judges from the Promoter. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on creative merit (“Judging Criteria”).

    The Prize
  15. The winner of the Competition will be able to bring a friend or family member to attend an exclusive ulta3 photoshoot.

  16. The prize includes: Transport within Victoria to the photoshoot location for the winner & one friend/family member, catering at the photoshoot, full face of makeup by professional makeup artist, 2 photos per person taken by a professional photographer on set, and a video of the experience.

  17. The prize may be subject to such other terms and conditions as may be imposed by those involved in providing other goods or services included in the prizes (Third Party Terms).

  18. The prize winner and/or their companion(s) are responsible for compliance with all applicable Third Party Terms and bear all risks associated with failure to comply with any of them. The Promoter assumes no liability (and will provide no compensation) to any prize winner and/or companion(s) who, as a result of any failure to comply with any Third Party Terms: a. are unable to participate in the prize (or any part of it); or b. suffer any other loss or damage.

  19. Prizes are not exchangeable, transferable, or redeemable for cash.

  20. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner.

  21. The date of the photoshoot is non- negotiable, and it is up to the winners to be available to attend on that date. If they are no available, they will forfeit the prize.

  22. The Promoter maintains the right to use the photography and videography captured from the experience on the day for marketing purposes online.

    Notification Of Winner & Verification Of Entrant
  24. The winner will be notified via their social medial channel – depending on the privacy settings the winner has stipulated for their account. The Promoter will request that the winner send the Promoter a private message or email with their full name, email, and phone number for prize notifications.

  25. The Promoter reserves the right to request verification of identity, residential address, and any other information from chosen winners.

  26. The Promoter reserves the right to disqualify any entrant or voter who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in, or benefits from in, any way in manipulating, interfering, or tampering with this promotion.

  27. Subject to any COVID-19 restrictions or any event outside the control of the Promoter, if a winner does not claim the prize by 5pm AEDT on the 15th November, 2021 following the winner being notified on the 8th November, 2021, or is otherwise disqualified from the Competition, the Promoter may assign the prize to the entry judged the next best entry in the Competition, or withdraw the prize, and the winner will forfeit any and all rights in and to the prizes.

  28. The judges’ decision is final and binding and no correspondence will be entered into. The Promoter accepts no responsibility for late or misdirected entries or other communications. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches or viruses. If such problems arise, then the Promoter may modify, cancel, terminate, or suspend the promotion.

  29. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their sole discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.

  30. The Promoter takes no responsibility for any harm, illness, or injuries caused by the prize.

  31. If the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may forfeit the prize all together.

  32. Any additional costs that are not within the prize conditions will need to be made by the winners.

  33. Any costs associated with entering the Competition and accessing the Instagram page are the responsibility of the entrant.

  34. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, pandemics, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right, to cancel, terminate, modify or suspend or recommence the Competition.

  35. Entrants consent to the Promoter using their full name, as communicated to the Promoter and/or represented on their Instagram profile in the event that they are a winner, in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.

  36. Entries, including the entrants’ photos/videos, remain the property of the Promoter. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant.

  37. The Promoter may post any entry to the ulta3 Instagram, Facebook and/or TikTok account to encourage ongoing entries. The Promoter may also use any entrant’s photo/video as inspiration to potential new entrants and customers.

  38. Each entrant acknowledges that this promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or Tik Tok (as applicable). In participating in this promotion entrants are providing information to the Promoter and not to Facebook, Instagram and/or Tik Tok. To the extent permitted by law, each entrant releases Facebook, Instagram and/or Tik Tok from any and all liability in relation to this promotion.
